While returning home, the car was being driven by Michelle who was in a drunken state. She drove quite dangerously, and though Rebecca gave several warnings, the car was crashed, and Rebecca thus sustained several injuries. She thus wanted to sue Michelle for negligence and in this assignment, this aspect shall be discussed. Issues The issues that arise in the given matter can be enumerated as under: Whether the given situation satisfies all the requirements under the tort of negligence and as such whether Michelle is liable in the matter? Whether Rebecca is liable for contributory negligence in the given scenario? Rules As defined in the case of Gnych v Polish Club Limited, [2015], a tort of negligence is a failure on the part of the defendant to exercise a duty of care that he was supposed to take. Any other reasonable and prudent person would have taken in similar circumstances that ultimately results in some losses to the plaintiff. This failure of duty of care in most cases is the causal factor for the damage that has been incurred by the plaintiff. Hence, according to the above definition, it can be said that there are four elements that should be satisfied to substantiate a claim of negligence (Claimsjournal.com, 2016). The defendant should have a duty of care towards the plaintiff; the defendant should breach this duty of care; the breach of the duty of care should result in some damage to the plaintiff and the damage that is caused should be a reasonably foreseeable one and not some remote cause (Oberdiek, 2013). Then, there are certain defenses that can be taken by a defendant when an accusation for being negligent is brought against him (Bolton v Stone, [1951]). The Civil Liability Act also ratifies these defenses. In case, contributory negligence is proved in any instance, the liability of the defendant comes down substantially. This has been specifically provided in Section 23 of the Act (Fletcher, 2008). To prove contributory negligence in any matter, intoxication is one of the valid grounds. Under Section 5 of the Civil Liability Act, intoxication has been laid down as a ground for establishing contributory negligence (Salmond, 2011). In such instances, the damages that are claimed can also be diminished by 100%. However, the adjudication is done by the Courts, and the decision is taken on the merits and facts of the case (Charlesworth and Percy, 2012). Two stages are involved in this process. The first shows the negligence done by the plaintiff and the second assigns a percentile issue on the same (Marcolongo v Chen, [2011]). Section 16 and 17 of the Civil Liability Act also need to be mentioned here. These deal with obvious risks and voluntary assumptions of risks. A person can say that he had not contributed in the negligence if he can without any doubts prove before the court that he was unaware of the risk present in the matter (Hobartlegal.org.au, 2016). Secondly, in case a person understands that there is some amount of risk associated with any incident, then he should look at it from the view of a reasonably prudent person. The mere presence of the knowledge of the risk is enough ground to substantiate that the plaintiff himself, who is responsible for the damage, and the defendant does not hold any liability in the matter (Cooke, 2007). Application These rules shall now be applied to the given factual background. Both Michelle and Rebecca were drunk in the situation. The wine was consumed by the in their wish. Since both of them were intoxicated, it can be said that driving on the part of either of them would have qualified to be a negligent act. In spite of knowing their intoxicated conditions, they chose to drive back home and thus, on the very first instance, negligence is proved beyond doubts in the matter. After that, it was realized by Rebecca that the condition of Michelle was not proper to let her drive and even then she allowed her to remain seated on the driver's seat. She also realized that she was driving dangerously and thus it can be said beyond any doubts that Rebecca was well aware of the drunken state of Michelle. Hence, it can be said that it would have been justified if Rebecca would not have accepted the offer of Michelle to drive her back home. However, Rebecca decided to choose on otherwise grounds and thu s contribution of Rebecca towards negligence is established without any reasonable doubts. This does not, however, absolve Michelle from any liability. She had a duty of care towards Rebecca and that she indeed breached the duty of care. A reasonably prudent person would not have made this breach in that place. The damages faced by Rebecca are attributable to the negligence of Michelle, and there is no remoteness to the damage in the matter. However, at the same time, it is also argued that Rebecca had the liability of contributory negligence. The risk that is the cause of the damage was pretty much foreseeable and obvious, and the voluntary acceptance of that risk by Rebecca proves her contribution to the negligence. Any other prudent person would have technically avoided that risk. The car after that met with the accident, and this resulted in injuries sustained by Rebecca and also gave her a broken leg. Thus, in these conditions, even if Rebecca accuses Michelle of negligence, the same cannot be awarded because of her liability in contributory negligence. Conclusion Thus, it can be concluded saying that: Michelle is, in fact, liable for negligence, and a suit can be maintained against her; Though Michelle has a liability, Rebecca cannot succeed in the claim because of her contributory negligence in the matter. Taoism is the way of the ultimate reality. It is where everything originated yet we can only experience. There are no words or pictures to describe it, and all we can know is it is within us, it is outside us, it is everywhere and nowhere. Taoism is the way of the universe. It is the driving power in everything which exists. It is natures orderer. It puts everything in its place without any spark of prejudice. Taoism is the way of human life. It is humans emulating water. It is humans doing by not doing. It is humans allowing nature to guide them. Confucianism follows the way of doing. Its model figure is the Chun Tzu who in our society could be likened to a moral leader. Humans strive to become the Chun Tzu (Superior Man) because they must serve others. To become a Chun Tzu, one must first follow the way of Jen by respecting themselves and maintaining a sensitivity towards all humanity. One must strive to be just to others and to be understanding of others emotions. One must also follow the Silver Rule of not doing those things they would not have others do to them. Another division between the two religions is their contrasting beliefs as to what force makes the other great. Taoists believe it is the way or the Tao that makes humans great. This is because it is the Tao by which humans are able to rejoin with nature. By rejoining nature, we are able to regain power in allowing nature to do things or things to do themselves. However, Confucianists believe it is humans that make the Tao great. This is because only through the efforts of humans can society become great. Humans make the Tao great by choosing to follow it, giving power to its force. There are opposite forces in all corners of life. There is no day without night and no good without evil. Like the Yin and the Yang, these opposing forces are halves of a greater whole. Just as these forces merge to create a vivid existence so too does Taoism and Confucianism combine to create a brilliance in the Chinese Character. Without one the other would be greatly flawed, but their joined beliefs and practices make the one as well as the infinite greater. It is not hard to see that our western society could learn a lesson from the teachings of Lao Tzu and Confucius. Nature which we have coldly ravaged and our own streets would be safer. Politicians would actually work for the society instead of the powerful few. Even art would be supported for its value in bringing people together. However, we could never hope to attain the dedication both require because of our deeply rooted individualistic attitudes. If we followed the practices of Confucianism and we believed that serving others is great honor, then our western world would be a safer one. There would be no illegal drug use or sells for we would know this is harmful to those we live to serve. There would be no crime for we would live by sharing all that we have with others eliminating the main cause of crime, the desire to have what we do not have. Life as we know it would be transformed into a peaceful world where we care for others regardless of who they are. If politics were conducted based on Confucianism, the government would be a vessel for society. Politicians would not be indentured to private causes driven by personal gain because they would believe that their purpose is to serve society. They would be the rightful protectors of all they govern. They would also uphold the principles of Li for they would understand that they have been given a chance to make society greater and to maintain its greatness. If we followed Taoism or Confucianism, we would fully support the arts of our days. We would provide the means for artist to flourish and places to share their works. There would be no art critics for the purpose of art is to bring society together. Critics are deconstructionists and they would be a hindrance in the natural expression of art. It is in the naturalism of art that the two religions find its power of unity. Run by the Chinese religions, our society would appreciate art not because peoples analysis finds it excellent but because art is a grounds of bringing people together. We look to the stars in search of our future when we only need look at ourselves to find it. Before we can reach the stars we must be one entity. Some average differences between individualist and collectivist cultures is that members of individualist cultures define the self as autonomous, independent of groups, give priority to individual, personal goals, they value independence, leadership, achievement and self-fulfillment, they give more weight to an individual’s attitudes and preferences than to group norms as explanations of behavior and they attend to the benefits and costs of relationships; if costs exceed advantages, a person is likely to drop a relationship (Wade Tavris, 2006). Members of collectivist cultures define the self as an independent part of groups, they give priority to the needs and goals of the group, the value group harmony, duty, obligation, and security, they give more weight to group norms than to individual attitudes as explanations of behavior and they attend to the needs of group members; if a relationship is beneficial to the group but costly to the individual, the individual is likely to stay in the relationship (Wade Tavris, 2006). I also read that in a revealing study comparing Japanese and Americans, the Americans reported that their sense of self changes only 5 to 10 percent in different situations, whereas the Japanese said that 90 to 99 percent of their sense changes (de Rivera, 1989). Sexual identity/orientation Sexual orientation is â€Å"a term used to identify a persons sexual attraction toward persons of a particular gender. Those sexually attracted to the opposite sex are said to display a heterosexual orientation, those attracted to the same sex, a homosexual orientation and to both, bisexual† (The Penguin Dictionary of Psychology, 2009). Sexual identity is â€Å"ones identity with respect to sexual orientation† (The Penguin Dictionary of Psychology, 2009). Evolutionary psychologists believe that gender roles and sexual scripts (sets of implicit rules that specify proper sexual behavior for a person in a given situation, varying with the person’s age, culture, and gender) reflect hard-wired biological sex differences that resulted from natural selection. In contrast, social and cultural psychologists believe that gender roles and sexual scripts reflect a culture’s economic, demographic, and social arrangements (Wade Tavris, 2006). In most cases it is hard to find the origin of sexual orientation because the sexual identity and behaviors take different forms. Some people are attracted to men and women, and some are heterosexual in behavior but have homosexual fantasies. Some men, such as prisoners, are homosexual in their behvaior because they lack opportunity for heterosexual sex, but they do not define themselves as gay and prefer women sex partners. In some cultures, teenage boys go through a homosexual phase that they do not define as homosexual and that does not affect their future relations with women. In today’s world there are many different culture therefore there are many sexual orientation/identity differences. We see poor, starving people in Africa. They suffer terribly, but there is no evidence that they haved sinned to the extent of being starved to death. Sin and suffering have been interpreted in different ways by different aspects of Christianity. Conservative Christians believe the Adam and Eve story to be literal history, and suffering is a direct consequence of their breaking of the covenant that Adam had with God. The Old Testament gives us an overall understanding of sin. Some beliefs include turning away from God and putting yourself before him. Similarly, Ezekiel’s apocalyptic prophecies tend to have close similarities with prophecies found in the revelations, which is another suggestion that the prophecy is more literal than figurative. In Ezekiel 40-42, Ezekiel describes a temple that is to be constructed and would be used for worshiping for not only the Israelites but also the entire world. For instance, the same way God showed Ezekiel a real temple, a similar temple was shown to David, which was later on to be built by Solomon in Jerusalem when he was king. Hence, in my opinion, the temple that God showed Ezekiel will also be built in Jerusalem.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The other reason why Ezekiel’s prophecy was more literal than figurative is due to the details covered in the chapters. Measurements of the temple walls as well as courtyards and gateways make the vision appear more literal. Although this vision is yet to be fulfilled, the book  of revelations states that there will be no temple constructed in the New Jerusalem since it is God and the lamb that will represent the temple. Due to this revelation, it is evident that the prophecy is literal since no temple will be constructed. Animal Sacrifices   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   In Ezekiel 44-46, Ezekiel talks of sacrifices that will be offered in the new temple. This prophecy is also literal since it is difficult to believe that sacrifices will come into existence again in the future. In my opinion, this prophecy is literal since instead of sacrifices, the vision depicts memorial sacrifices similar to those that occurred during the first coming of Jesus Christ such as the last supper. During the last supper, Jesus asked his disciples to use bread and wine in his commemoration. This implied that God prefers this form of commemoration rather than the regular sacrifice.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   In my opinion, the sacrifice visualized in the temple by Ezekiel is more literal than symbolic since it represents the presence of Jesus rather than the literal animal sacrifice. Through this, it is evident that the temple visualized by Ezekiel will be fulfilled by Jesus’ second coming. In Ezekiel 45-46, he talks of a prince who will carry out his roles with justice and righteousness. For instance, when it comes to tax, this prince will ensure that he takes only what one can afford, this is in relation to one’s financial ability. Due to this revelation, it becomes evident that the prophecy ought to be understood as literal and not figurative.
